In order to enable their quotation to be drawn up and to determine the price, candidates must have, in particular in the context of a formal award procedure which does not allow for negotiation with the contracting authority, information on the date of the bid. completion of the contract.
Rule n ° 3:
The contracting authority has the choice between two options.

The contracting authority decides to leave to the candidates the possibility to fix a date of completion of the services. In this case, the Council of State requires the contracting authority to supervise this option, for example by setting a deadline or a range of possible dates for the expiry of the contract, without this being possible, taking into account the criteria bid selection, it results in an uncertainty such that it does not allow the candidates to usefully present an offer.
