The contractual intermediary is also admissible if the contracting authority merely refers to the provisions of article 80 of the Code des Marches Publics in the rejection letter without specifying the minimum period of suspension before the signature of the contract.

The contractual referent is admissible even when the unsuccessful candidate has introduced a pre-contractual referral since he was in ignorance of the signature of the contract as a result of a failure of the contracting authority to the provisions of Article 80 of the Code des marchés which provide for the obligation to notify applicants of the rejection of their tenders and the obligation to comply with a minimum period of 16 days or 11 days before the signature of the contract, depending on whether the notification is made by registered mail or electronically.
