Adapted procedure contract and equality between candidates: the criteria for judging tenders must not have the effect of favoring a candidate!
Rule n ° 1:
In the context of an adapted procedure, a contracting authority may adopt as a criterion for judging tenders a criterion for the admissibility of applications, such as the applicant's experience in the field covered by the contract.
Rule n ° 2:
The use of such a criterion can not be done in disregard of the principle of equal treatment of candidates for public commission and give an excessive advantage to a candidate and penalize other candidates especially when the required references concerns a particular field.
