The judge of pre-contractual recourse must uphold the adversarial principle

Rule n ° 1:

The decisions taken by the judge of pre-contractual summary proceedings are issued following a particular procedure which, while being adapted to the need to ensure a rapid decision, must guarantee the contradictory nature of the investigation.

Rule n ° 2:

If an applicant decides to raise new grounds at the hearing, he must record them in a written submission. In this case, the judge of pre-contractual recourse must allow the defendant to take cognizance of this brief and may also decide that the closing of the investigation will not intervene at the end of the hearing but postpone it to a later date.

Rule n ° 3:

The parties must now be able to take cognizance of the brief containing new means and elements by taking the decision not to close the investigation and to defer the hearing.
