Pre-contractual & Contractual referral

The pre-contractual procedure referred to in Article L 551-1 of the Administrative Justice Code makes it possible to sanction breaches of the publicity and competition requirements that may affect the award of public contracts, public service delegations, partnership agreements and all the contracts subject to the order n ° 2015-899 of 23 July 2015 relative to the public markets and to the ordinance n ° 2016-65 of 29 January 2016 relative to the concession contracts.

Rule n ° 1

The contracting authority may limit the number of lots likely to be awarded to the same candidate. On the other hand, it can not force the candidates to submit an offer for each lot (1st June 2011, Sté Koné, n ° 346405).

Rule n ° 2

A candidate who has not submitted his application for the allocation of all the lots of a contract is admissible to ask the judge of the pre-contractual summary that the cancellation of the procedure of allocation of the lot or lots for which he has applied, unless, under the provisions of the consultation rules prohibiting any candidate from being awarded more than one of the three lots of the contract, he must be regarded as having been deprived of the opportunity to submit usefully apply for all lots on the market.
