The public purchaser is required to control the technical and financial capacities of the candidates including when it is a recent company

The solution rendered by the judge of the pre-contractual recitals of the Administrative Court of Nîmes is in line with the Council of State which recalls that the contracting authority "must control the professional, technical and financial guarantees of the candidates for the award of a public contract "(EC 12 November 2015, SAGEM, 386578, EC 26 March 2008, Lyon Urban Community, 303779). The pre-contractual judge is well qualified to check whether a candidate has sufficient technical and financial guarantees for the performance of the contract, in the light of the requirements laid down in the regulation of the consultation of the contract. In this respect, the contracting authority can not limit itself to checking the completeness of the application, but must make an assessment of the professional, technical, and financial capacities of each candidate to perform the contract (CE 29 April 2011, Garde des Seals , Minister of Justice and Freedoms, No. 344617).
In the event of litigation, it is up to the public purchaser to demonstrate that he has really been able to control the technical and financial capacities of the candidates and to produce the justifications for this control (CE 17 September 2014, Société Delta Process 378722) it does not matter whether the successful candidate is a newly created company since even in this case, the candidate must produce supporting documents proving that he has sufficient technical and human technical capacities (EC 9 May 2012 , Municipality of Saint-Benoit, application No 359455) .It is therefore the responsibility of the contracting authority in the context of a pre-contractual interim procedure to justify the capacity of the successful tenderer to perform the services which are the subject of the contract, where appropriate, by producing extracts from the successful tenderer's application file.
In the present case, however, the Commune in question awarded the contract to a newly created company without carrying out that prior check in breach of the principle of equality between the candidates, which the pre-contractual interlocutory judge immediately sanctioned.
