In his conclusions on this case, the Rapporteur Nicolas BOULOUIS explains this solution in these terms:e contractual referent is not open to those who have not been prevented in any way from making a pre-contractual referral, freely choosing to wait for the signature of the contract to obtain its cancellation or other compensation by way of summary contractual. By definition, can not complain of a breach of one of the two deadlines, they will not fulfill any of the conditions required for the application of Articles L 551-18 or L 551-20 of the Administrative Justice Code. ".
The rule is therefore clear and does not suffer from any derogation: once the contracting authority has notified a rejection letter specifying the deadline for introducing a possible pre-contractual referral as well as the territorially competent administrative court, the unsuccessful candidate who has not not exercised a pre-contractual summary in the period of suspension is no longer admissible to form a contractual referent.
The facts of this case give a very clear illustration of the application of this rule: by letter dated April 11, 2014, the General Council of Var informed the applicant company of the rejection of its offers for the different lots to which it has participates. This letter of rejection clearly indicated the possibility of introducing a pre-contractual summary before the Administrative Court of Toulon within 16 days.
However, the applicant company decided not to initiate a pre-contractual summary within the 16-day standstill period which was open to it.
The contracts relating to the contested lots were therefore signed after the expiry of the 16-day period following the notification of the rejection letter in accordance with Article 80 of the Public Procurement Code.
As the applicant company was not prevented from introducing a pre-contractual injunction and the General Council complied with a deadline of more than 16 days before the signing of the contracts, the judge hearing the application for interim relief of the Toulon Administrative Court considered that it was more admissible to refer the matter to the judge of the
